THE woman who claims Justin Bieber fathered her baby could be investigated by police for statutory rape.
Mariah Yeater, 20, says she had sex with the singer last year after being invited backstage to meet him at a concert in LA.In a lawsuit lodged in San Diego, she has demanded that Bieber take a paternity test and "provide adequate support" for her four-month-old boy.
Bieber has denied the claims, calling them "malicious and defamatory".
LA police could be obliged to investigate the claims because Bieber was 16 at the time of the allegation.
Police Commander Andrew Smith told AP: "If it's brought to our attention, of course we'll look into it."
Mariah had just turned 19 when she says she and Bieber had sex. She said Bieber had told her it was his first time and was embarrassed it lasted 30 seconds.
She says she gave birth to a boy, Tristyn, in July and believes Bieber was the father because there were no other possible men she had sex with at that time.
She is asking a judge for child support and a paternity test. A hearing is scheduled for December 15.
California law states anyone who has unlawful sex with a minor and is not more than three years older is guilty of a misdemeanour, which carries up to a one-year jail sentence.
"The issue of statutory rape even if she's guilty has no bearing on the duties to provide child support," said Mariah's lawyer Matthew Pare.
"It's a totally separate issue."
Bieber fans have already tweeted death threats against her. One fan said: "I could kill this bitch. SHE IS SOOO DEAD."
